A couple from Cedar Falls recently went to court after filing a lawsuit against a Waterloo doctor, whom they say injured their daughter when he was delivering her in November 2006.
According to the lawsuit, the baby girl's shoulder became stuck when she was being delivered. This resulted in a condition known as shoulder dystocia, which the doctor failed to prevent, diagnose, or treat during the delivery. The lawsuit further states that the girl, who is now 4-years-old, has permanent injuries to her brachial plexus and limited use of her left arm because of the injuries she suffered during birth. She now sees a physical therapist to prevent the condition from getting worse.
The family is seeking over $1.2 million in damages for pain and suffering, loss of childhood consortium, and loss of future earnings.
