A construction company is being sued for $10 million by a former employee who lost his leg in an on-the-job accident. His boss was backing up a pickup truck when she accidently ran him over. The man's injuries were so severe his leg had to be amputated.
Now he is seeking $10 million in damages including medical expenses, lost income, his wife's emotional distress, and unpaid overtime. The man's employer believes he should receive compensation for his injuries, but wants to cap it at $50,000 following workers' compensation laws. He argues that he should not be limited by workers' compensation laws because he was not covered by workers' compensation insurance at the time of the accident.
