David Driesen of Orange City, Iowa, has filed a lawsuit against Chicago & Eastern Railroad Corporation, which is based in Minnehaha, South Dakota. His wife Denise and the state of Iowa are also plaintiffs in the lawsuit. It concerns an accident that occured on December 18, 2006, near Spencer, Iowa. Driesen was serving in his capacity as a state trooper when his car collided with an empty freight car that had been left on the tracks.

The Driesens and the state are arguing that the railroad company was negligent in many ways contributing to the accident. The 16 complaints listed in the suit include leaving a car on the tracks for too long, failing to mark the tracks with a reflective sign for motorists, not appointing anyone to stand near the tracks and wave cars away, and not alerting railroad employees to the car stalled on the tracks. The Driesens are seeking unspecified damages for David's broken bones and internal injuries.
